1. Research the zoning restrictions of your residential area to ensure that you may operate the type of home-based business you plan to open. The Pennsylvania Department of Labor and Industry will help you determine whether your business is legal to operate, as well as inform you of any restrictions you may have to adhere to.
2. Register a fictitious name for your business with the Pennsylvania Department of Labor. The fictitious name, which is also referred to as a Doing Business As license, will be the name under which your business operates. Without a fictitious name registration, you cannot file for an Employer Identification Number or business license.
3. Select a legal structure for your home-based Pennsylvania business. Most small businesses are filed as sole-proprietorships, though you may select a partnership, or limited liability corporation depending on the number of people involved with your home-based business.
4. Contact the Internal Revenue Service to obtain an Employer Identification Number (EIN) so that you may pay employees or individuals working for you. The IRS will require your personal identification information, business name and business address in order to issue an EIN.
5. Register to pay state taxes with the Pennsylvania state tax office. As a home-based business in Pennsylvania, you will be required to pay state taxes once a month on any income you earn from goods or services sold. The state tax office will require your personal identification information, as well as any information about your business necessary to determine your state tax bracket.
6. Contact the Pennsylvania Department of State to obtain a business license for your home-based business. The business license may take anywhere from a few days to two weeks to be issued to you. The fee for the license is $15 as of 2010.
